The Resolution CD/ANPD No. 18/2024, which approves the Regulation on the Role of the Data Protection Officer, has been published in the Official Gazette of the Union.
Through this Regulation, the National Data Protection Authority (ANPD) seeks to clarify the rules applicable to the role of the data protection officer, establishing parameters for their duties and performance, in line with the Brazilian General Data Protection Law (Law No. 13.709/2018 – LGPD). This topic had already been the subject of a call for contributions, public consultation, and public hearing, during which the ANPD was able to collect contributions from society and hear from key economic sector stakeholders.
The Regulation includes important topics related to the data protection officer’s role, such as:
/ appointment procedure;
/ disclosure of identity and contact information;
/ characteristics, activities, and duties;
/ conflict of interest scenarios; and
/ duties of data processing agents.
