On January 31, Decree No. 11,907/2024 was published, creating the Secretariat of Prizes and Betting (SPA) under the Ministry of Finance (MF).
The SPA will be divided into three sub-secretariats that will perform the following functions:
- Regulate the betting market, online games, lotteries, and commercial promotions;
- Monitor and supervise this market, especially issues related to corruption, money laundering, and other crimes;
- Evaluate and grant operators’ authorization requests to exploit this market, as well as requests for conducting commercial promotions;
- Monitor the collection of federal taxes owed by operators and bettors;
- Adjudicate Administrative Sanctioning Procedures (at the first instance) and requests for review;
- Determine the application of administrative sanctions or the closure of the process;
- Propose signing a commitment agreement with the infringing party, per the provisions of the Betting Statute (Law No. 14,790/23), at any stage of the administrative process.
